Terms of Service

These Terms of Service ("Terms") govern your access to and use of BizNote("Service"), operated by BizNote ("we", "us", or "our"). By using the Service you agree to these Terms. If you disagree, do not use the Service.

1. Description of service

BizNote provides a free business scan using information supplied by business owners and, optionally, limited observations from one authorized public webpage. Signed-in owners can save a business to their account and receive one current priority with a prepared draft or checklist, record what happened, and complete a short weekly check-in. The first priority is included with a saved business. Weekly notes, described in section 4, continue this per business: each week follows up on the open priority or prepares the next one, with a weekly email. The Service does not monitor websites, listings or other businesses and does not publish changes on your behalf.

Saved business details, priorities, drafts and check-ins stay in your account until you remove the business or delete your account. Free scans and their website observations expire seven days after they are created.

2. Eligibility

You must be at least 18 years old and have the legal authority to act on behalf of the business you are scanning. By submitting a business for analysis, you represent that you are authorized to do so.

3. Free scan

The free scan does not require an email address or payment. It uses your IP address and device to apply rate limits. As a general guide, free scan visitors can run up to 5 free scans per 10-minute window per IP address. We reserve the right to throttle or restrict free scans to prevent abuse.

4. BizNote subscription

Weekly notes are a paid subscription per saved business, billed monthly through Stripe at $39 per month. A payment card is required to start. By subscribing you authorize us to charge your payment method on a recurring basis until you cancel. Weekly notes include weekly follow-through for one business: your saved goals and constraints, one current priority with a prepared draft or checklist, owner status updates, a short weekly check-in, and a weekly email. Cancel anytime.

• Cancellation: You may cancel anytime. Cancellation takes effect at the end of your current billing period. You retain access until then.
• Refunds: If BizNote did not surface useful insights within your first billing period, contact us for a full refund — no questions asked. After the first billing period, refunds are at our discretion.
• Per-business billing: Subscriptions are attached to individual businesses, not user accounts. Each business you subscribe requires a separate subscription.

5. Use of public data

Public availability does not transfer ownership or grant unrestricted rights to third-party content.

The Service includes Google Maps features and content. Their use is subject to the Google Maps End User Additional Terms of Service and the Google Privacy Policy. Third-party content remains subject to its owners’ rights and applicable terms.

You must own or manage the website and have permission for BizNote to process the submitted information and public page. Public availability alone does not grant unrestricted rights. The current scan does not use Google Places content. We do not guarantee the accuracy, completeness, or timeliness of data sourced from third parties. Website observations reflect the page at the time of the scan and are shown with their date.

6. AI-generated content

Website observations are limited to one page’s HTML and may miss dynamically rendered content. Priorities, drafts and checklists are generated with AI from your saved details, your check-ins and any unexpired website observations; they are proposals, not measured problems, and may contain errors, omissions, or inaccuracies. They are not professional legal, financial, or medical advice. You are solely responsible for decisions made based on them and for anything you publish.

7. Prohibited uses

You agree not to:

• Use the Service to scrape, harvest, or redistribute data at scale.
• Attempt to circumvent rate limits or abuse prevention measures.
• Reverse-engineer or resell any portion of the Service.
• Use the Service for any unlawful purpose.

8. Intellectual property

The BizNote platform, branding, and interface are owned by us. Report content generated for your business is yours to use for your own business purposes. You may not redistribute, resell, or publish reports without our written consent.

9. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by law, BizNote and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service — even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time. We will give reasonable notice for material changes affecting paid subscribers.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.
