Terms of Service

These Terms of Service ("Terms") govern your access to and use of BizNote("Service"), operated by BizNote ("we", "us", or "our"). By using the Service you agree to these Terms. If you disagree, do not use the Service.

1. Description of service

BizNoteprovides AI-generated business intelligence reports for local businesses using publicly available data including Google Business Profile information, public reviews, and nearby competitor data. The Service includes a free scan tier and a paid subscription tier ("BizNote").

2. Eligibility

You must be at least 18 years old and have the legal authority to act on behalf of the business you are scanning. By submitting a business for analysis, you represent that you are authorized to do so.

3. Free scan

The free scan requires an email address and no payment. It uses your IP address and device to apply rate limits. As a general guide, free scan visitors can run up to 5 free scans per 10-minute window per IP address. We reserve the right to throttle or restrict free scans to prevent abuse.

4. BizNote subscription

BizNote is a paid subscription per tracked business, billed through Stripe. Plans are offered on a monthly basis ($39/month) or an annual basis ($374/year, approximately $31/month). By subscribing you authorize us to charge your payment method on a recurring basis until you cancel.

• Cancellation: You may cancel anytime. Cancellation takes effect at the end of your current billing period. You retain access until then.
• Refunds: If BizNote did not surface useful insights within your first billing period, contact us for a full refund — no questions asked. After the first billing period, refunds are at our discretion.
• Per-business billing: Subscriptions are attached to individual businesses, not user accounts. Each business you subscribe requires a separate subscription.

5. Use of public data

BizNote relies on publicly available data from Google Places and other public sources to generate reports. We do not guarantee the accuracy, completeness, or timeliness of data sourced from third parties. Report content reflects public signals at the time of generation.

6. AI-generated content

Reports are generated using AI models (OpenAI). AI output may contain errors, omissions, or inaccuracies. BizNote reports are intended to surface insights and suggested actions — they are not professional legal, financial, or medical advice. You are solely responsible for decisions made based on report content.

7. Prohibited uses

You agree not to:

• Use the Service to scrape, harvest, or redistribute data at scale.
• Attempt to circumvent rate limits or abuse prevention measures.
• Reverse-engineer or resell any portion of the Service.
• Use the Service for any unlawful purpose.

8. Intellectual property

The BizNote platform, branding, and interface are owned by us. Report content generated for your business is yours to use for your own business purposes. You may not redistribute, resell, or publish reports without our written consent.

9. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by law, BizNote and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service — even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time. We will give reasonable notice for material changes affecting paid subscribers.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.
